I. General Terms

  • Terms and Conditions – these terms and conditions
  • Service – the "GuideTravio.com" online service, operating at https://GuideTravio.com
  • Service Provider – SoftEnd Kamil Rodak, with the registered office address: Bożnów 107, 68-100 Żagań, NIP: 9241889830
  • Service Recipient – any natural person who accesses the Service and uses the services provided through the Service by the Service Provider.
  • Electronic Communication – Communication between the parties via email.
  • Recurring Payment – a payment method for subscription services requested by the User, involving periodic automatic charging of the User’s payment card with the appropriate subscription fee, as specified in the Terms and Conditions.

II. General Provisions

  • The Terms and Conditions specify the rules for the functioning and use of the Service and define the rights and obligations of the Service Recipients and the Service Provider related to the use of the Service.
  • The subject of the Service Provider's services is to provide paid tools in the form of the Service, enabling Service Recipients to access content in the form of posts, articles, and audiovisual materials or web applications and electronic forms.
  • All content, articles, and information containing features of guidelines or advice published on the Service are general information only and are not directed to individual Service Recipients. The Service Provider is not responsible for the use of these by the Service Recipients.
  • The Service Recipient assumes full responsibility for the manner of using the materials provided within the Service, including using them in accordance with applicable law.
  • The Service Provider gives no guarantee regarding the usefulness of the materials placed in the Service.
  • The Service Provider is not responsible for any damages incurred by the Service Recipients or third parties in connection with the use of the Service. All risks associated with the use of the Service, particularly the use and application of information contained in the Service, are borne by the Service Recipient.

III. Terms of Use of the Service

  • Using the Service by any Service Recipient is paid. The fee is charged monthly. Recurring Payment is handled by external services EasyCart.pl and Stripe.net.
  • The Service Provider does not have access to the payment card details of the Service Recipient.
  • Service Recipients are required to read the Terms and Conditions and other documents that are an integral part of it and must accept its provisions in full to continue using the Service.
  • Service Recipients may not use any personal data obtained in the Service for marketing purposes.
  • Technical requirements for using the Service:
    • a device with a display that allows displaying web pages,
    • internet connection,
    • any web browser that displays web pages according to W3C Consortium standards and supports HTML5 web pages,
    • enabled JavaScript,
    • enabled Cookies,
    • enabled geolocation
  • To ensure the security of the Service Provider, Service Recipients, and other Service Recipients using the Service, all Service Recipients using the Service should follow the generally accepted internet safety rules,
  • Actions prohibited to be performed by Service Recipients or through software:
    • without written consent, decompiling and analyzing the source code,
    • without written consent, causing excessive server load,
    • without written consent, attempting to detect security vulnerabilities of the Service and server configuration,
    • attempting to upload or inject code, scripts, and software onto the server and into the database that may harm the Service software, other Service Recipients, or the Service Provider,
    • attempting to upload or inject code, scripts, and software onto the server and into the database that may track or steal data from Service Recipients or the Service Provider,
    • undertaking any actions aimed at damaging, blocking the operation of the Service, or preventing the achievement of the purpose for which the Service operates.
  • If an incident of cybersecurity or a GDPR violation is detected or potentially possible, Service Recipients should report this to the Service Provider first to quickly eliminate the problem/threat and secure the interests of all Service Recipients.

IV. Terms and Conditions of Registration

  • Service Recipients can use the Service without registration.
  • Service Recipients must be registered and have an account in the Service to use additional services available only to logged-in Service Recipients.
  • Registration in the Service is voluntary.
  • Registration in the Service is free, but full use of the service is possible only after payment.
  • Each Service Recipient may have only one account in the Service.
  • Technical requirements for account registration:
    • having an individual email account,
  • Service Recipients registering in the Service consent to the processing of their personal data by the Service Provider to the extent entered into the Service during registration and their subsequent changes or deletion.
  • The Service Provider has the right to suspend or delete Service Recipients' accounts at its discretion, preventing or limiting access to certain or all services, content, materials, and resources of the Service, especially if the Service Recipient violates the Terms and Conditions, generally applicable laws, social coexistence rules, or acts to the detriment of the Service Provider or other Service Recipients, justified interest of the Service Provider, and third parties cooperating or not with the Service Provider.
  • All services of the Service may be changed in their content and scope, added or removed, or temporarily suspended or restricted at the Service Provider's discretion, without the possibility of objection by the Service Recipients.
  • Additional security rules for account use:
    • Registered Service Recipients are prohibited from sharing their login and password with third parties.
    • The Service Provider has no right and will never request the Service Recipient's password for the selected account.
  • Account deletion:
    • Each Service Recipient with an account in the Service can independently delete their account from the Service.
    • Service Recipients can do this by logging into the panel in the Service.
    • Deleting an account results in the deletion of all identifying data of the Service Recipient and anonymization of the username and email address.
    • If the Service Recipient has an active GuideTravio.com Audioguide service, account deletion will be possible only after canceling the service and completing the billing period.

V. Terms and Conditions for Using the GuideTravio.com Audioguide

  • Using the Audioguide requires a registered account and activation of Recurring Payment on the https://easycart.pl/ service.
  • The service involves access to audio recordings describing the places visited by the Service Recipient.
  • To operate the service correctly, access to the Service Recipient's current location obtained through geolocation is needed.
  • The Service Recipient's geolocation data is not stored by the Service Provider and is only used to find relevant places nearby the Service Recipient.
  • The Service Recipient has the opportunity to use a 14-day trial period once, after which, if no cancellation is made, it switches to a paid plan according to the subscription plan chosen by the Service Recipient.
  • The Service Recipient can cancel the service at any time by logging into the account created during the activation of the recurring payment on https://easycart.pl/.
  • After canceling the service by the Service Recipient, the service will remain active until the end of the billing period and then be automatically deactivated.

VI. Terms and Conditions for the Newsletter Service

  • Service Recipients can use the Service without subscribing to the Newsletter.
  • Subscription to the Newsletter service is voluntary.
  • Subscription to the Newsletter service is free.
  • Technical requirements for the Newsletter service:
    • having an individual email account,
  • Terms of the Newsletter service:
    • providing an individual email account in the electronic form,
    • verification of the provided email account by activating the link sent to it,
    • consent to receive email notifications,
  • Scope of the Newsletter service:
    • notifications about new updates, posts, contests, and other promotional activities related to the Service's services,
    • notifications about promotional activities of the Service's partners (Marketing messages),
  • Unsubscribing from the Newsletter service:
    • Each Service Recipient subscribed to the Newsletter service can independently unsubscribe from the Service.
    • Service Recipients can do this through the link included in each sent email message.
    • Unsubscribing from the Newsletter service results in blocking all marketing messages.

VII. Terms of Communication and Provision of Other Services in the Service

  • The Service provides contact details in the form of:
    • Email address
  • In the case of contacting the Service Provider, Service Recipients' personal data will be processed in accordance with the Privacy Policy, which is an integral part of the Terms and Conditions.

VIII. Data Collection about Service Recipients

To properly provide services through the Service, secure the legal interest of the Service Provider, and ensure the Service's compliance with applicable law, the Service Provider collects and processes some data about Users through the Service.

To properly provide services, the Service uses and stores some anonymous information about the Service Recipient in cookies.

The scope, purposes, methods, and rules of data processing are available in the attachments to the Terms and Conditions: GDPR Information Obligation and in the Privacy Policy, which are an integral part of the Terms and Conditions.

  • Automatically collected data:
    To ensure the proper functioning of the Service and for statistical purposes, we automatically collect some data about the Service Recipient. This data includes:
    • IP address
    • Browser type
    • Screen resolution
    • Location
    • Visited subpages of the service
    • Time spent on the respective subpage of the service
    • Operating system type
    • Address of the previous subpage
    • Referring page address
    • Browser language
    • Internet connection speed
    • Internet service provider
    • Anonymous demographic data based on Google Analytics data:
      • Gender
      • Age
      • Interests
    • Anonymous data necessary for serving ads:

    The above data is obtained through the Google Analytics script and is anonymous.

    Username, first and last name, email address

    For logged-in Service Recipients (having an account in the Service), a Service Recipient identifier linked to the Service Recipient's account may be stored in cookies on the Service Recipient's device.

  • Data collected during newsletter subscription:
    Email address

IX. Copyright

  • The owner of the Service and the copyrights to the Service is the Service Provider.
  • Some data posted on the Service is protected by copyrights belonging to companies, institutions, and third parties unrelated to the Service Provider and is used based on obtained licenses or free licenses.
  • According to the Act of February 4, 1994, on Copyright, it is forbidden to use, copy, reproduce in any form, and store in search systems, except for Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook, and LinkedIn, any articles, descriptions, photos, and any other content, graphic materials, videos, or audio materials found in the Service without the written consent or consent conveyed via Electronic Communication from their legal owner.
  • According to the Act of February 4, 1994, on Copyright, simple press information, understood as information alone, without commentary and evaluation by the author, is not protected. The author understands this as the possibility of using information from the texts posted on the service but not copying the whole or parts of articles unless marked in the individual material made available in the Service.

X. Changes to the Terms and Conditions

  • Any provisions of the Terms and Conditions may be changed unilaterally by the Service Provider at any time, without providing reasons.
  • Information about the change of the Terms and Conditions will be sent via Electronic Communication to Service Recipients registered in the Service.
  • In case of changes to the Terms and Conditions, their provisions come into force immediately after their publication for Service Recipients who do not have accounts in the Service.
  • In case of changes to the Terms and Conditions, their provisions come into force with a 7-day transition period for Service Recipients who have accounts in the Service registered before the change of the Terms and Conditions.
  • It is assumed that every Service Recipient who continues to use the Service after the change of the Terms and Conditions accepts it in full.

XI. Final Provisions

  • The Service Provider will make every effort to ensure the Service is offered continuously. However, it is not responsible for disruptions caused by force majeure or unauthorized interference by Service Recipients, third parties, or the activities of external automatic programs.
  • The Service Provider reserves the right to change any information posted on the Service at a time chosen by the Service Provider, without the need to inform Service Recipients using the Service in advance.
  • The Service Provider reserves the right to temporarily, completely, or partially disable the Service to improve it, add services, or perform maintenance, without prior notice to Service Recipients.
  • The Service Provider reserves the right to permanently disable the Service without prior notice to Service Recipients.
  • The Service Provider reserves the right to transfer, in part or in full, all its rights and obligations related to the Service without the consent and possibility of objection by the Service Recipients.
